Our offer, whether in the form of a purchase order for the purchase of goods or a quotation or contract for the sale of goods (in either case, our “Offer”), is subject to the applicable general terms and conditions linked below. Our Offer along with the applicable terms and conditions linked below (together, the “Contract”) constitute the entire agreement regarding the purchase or sale of the goods, as applicable, except where a separate written agreement has been entered into by the parties that covers the transaction. The Contract prevails over any additional terms or conditions contained in any other documentation that you provide, including your general terms and conditions. Mitsui objects to and rejects any additional terms in your documentation which add to, vary from, or conflict with the Contract.
